By accessing and using Learnella ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

Learnella is an educational platform that provides:

• Quiz creation and management tools
• Student assessment and analytics
• AI-powered feedback and insights
• Group and classroom management features
• Educational content delivery

3. User Accounts and Registration

3.1 Account Creation

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process.

3.2 Account Security

You are responsible for safeguarding the password and for maintaining the confidentiality of your account. You agree not to disclose your password to any third party.

3.3 User Types

The Service supports different user types including students, teachers, and school administrators, each with different access levels and responsibilities.

4. Acceptable Use Policy

You agree not to use the Service to:

• Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, or otherwise objectionable
• Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity
• Interfere with or disrupt the Service or servers or networks connected to the Service
• Attempt to gain unauthorized access to any portion of the Service
• Use the Service for any commercial purpose without our express written consent

5. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

5.1 Educational Data

We understand the sensitive nature of educational data and are committed to protecting student information in accordance with applicable privacy laws, including FERPA and COPPA where applicable.

6. Intellectual Property Rights

6.1 Service Content

The Service and its original content, features, and functionality are owned by Learnella and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 User Content

You retain ownership of content you create and upload to the Service. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and distribute your content solely for the purpose of providing the Service.

7. Service Availability and Modifications

We strive to maintain the Service's availability but cannot guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.

8. Payment Terms and Billing

8.1 Subscription Plans

Learnella offers subscription-based services with different pricing tiers:

• Individual Teacher Plan: $19/month for unlimited access to all features
• School Plan: $2 per student per month with flexible student limits
• Free Trial: 4 free lessons, quizzes, or AI feedback sessions for new users

8.2 Payment Processing

All payments are processed securely through PayPal. We do not store your credit card information on our servers. Payment processing is subject to PayPal's terms of service and privacy policy.

8.3 Billing Cycle

Subscriptions are billed monthly on a recurring basis. You will be charged the subscription fee on the same day each month until you cancel your subscription.

8.4 Refund Policy

We offer a 30-day money-back guarantee. If you are not satisfied with our service, contact us within 30 days of your purchase for a full refund. Refunds will be processed within 5-10 business days.

8.5 Cancellation

You may cancel your subscription at any time through your account settings or by contacting our support team. Cancellation will take effect at the end of your current billing period. No refunds will be provided for partial months.

8.6 Price Changes

We reserve the right to change subscription prices with 30 days' notice. Price changes will not affect your current billing cycle but will apply to subsequent renewals.

8.7 Failed Payments

If a payment fails, we will attempt to process the payment again. If payment continues to fail, your subscription may be suspended until payment is successfully processed.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Learnella shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

9.1 Service Availability

We do not guarantee uninterrupted access to the Service. We are not liable for any damages resulting from service interruptions, technical issues, or maintenance periods.

9.2 Educational Content

We are not responsible for the accuracy, completeness, or usefulness of any educational content created by users. Users are responsible for verifying the accuracy of their content.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

10.1 Account Deletion

Upon termination, your account and associated data may be permanently deleted. We will retain certain information as required by law or for legitimate business purposes.

10.2 Effect of Termination

Upon termination, you will lose access to all paid features and your subscription will be cancelled. No refunds will be provided for partial months unless required by law.

11. Dispute Resolution

Any disputes arising from these Terms or your use of the Service will be resolved through binding arbitration in accordance with the laws of Kyrgyzstan.

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kyrgyzstan, without regard to its conflict of law provisions.

11.2 Arbitration

Any disputes will be resolved through binding arbitration in Bishkek, Kyrgyzstan. The decision of the arbitrator shall be final and binding.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date.

12.1 Notification of Changes

For material changes affecting billing or subscription terms, we will provide at least 30 days' notice via email to affected users.
